The terms and conditions contained herein alongwith the Privacy Policy, terms and conditions of SMSmyEmail service form an agreement regulating our relationship with regard to the use of SMSmyEmail service. You are advised to read this Agreement carefully. If you are not agreeable to any terms and conditions, you should not accept them. You can use the SMSmyEmail service if you are agreeable to all the terms and conditions of this Agreement in their entirety. You agree to abide by and bound by the Terms and Conditions. Vahati reserves the right to modify the terms and conditions ("Terms") of the Service and Disclaimer without any prior notification. You are advised to regularly review the Terms. If you do not agree with any of the Terms and any amendments thereto, you must not use this site/service.

SMSmyEmail service from Vahati allows you to receive eMail as alerts on your mobile phone in the form of a SMS text message (upto 160 charaters), provided you register your eMail account information from which you want to recieve eMail along with appropriate filters if any. You acknowledge and agree that mobile phone number you are using to access your eMails will be registered by you with Vahati SMSmyEmail service. Vahati does not guarantee that SMSmyEmail will be accessible at all times and be fault-free. You will not be able to use SMSmyEmail service if your mobile phone account you are using to recieve email alerts is suspended or disconnected, either temporarily or permanently.

Vahati reserves the right to terminate the SMSmyEmail service or your access to SMSmyEmail account at any time without prior intimation. SMSmyEmail service is subject to Vahati's network capacity restrictions. Vahati reserves the right to alter or modify SMSmyEmail service without notice to you, including the exercise of Vahati's rights.

SMSmyEmail may charge you for every SMS text message while you use SMSmyEmail service irrespective of whether the message is successfully delivered to, or received by you. You are advised to please check the rates with SMSmyEmail website. In the event your connection gets disconnected for any reason whatsoever, you are advised to disable the SMSmyEmail service. Vahati will not be responsible if you are being charged for the SMSmyEmail service by SMSmyEmail even after your connection is disconnected.

Vahati does not screen or censor any message that you may receive and expressly excludes all liability to you for any breach of any express or implied Term.

Without limiting any other terms, Vahati will not be liable for any claim, loss, or damage arising as a result of:
(a) your use of the SMSmyEmail service;
(b) a message not being secure;
(c) the content of eMail alert messages you recieve using SMSmyEmail service;
(d) a failure to deliver a eMail alert message by SMSmyEmail service in a timely manner;
(e) any failure of SMSmyEmail service to be continuous or fault-free.
(f) any charges that may be levied by the SMSmyEmail service even after your connection gets disconnected.

This service is brought to you as a matter of personal convenience and for non-commercial purpose. You agree that you are using the service/site at your sole risk.

Disclaimer of Warranties: YOU EXPRESSLY AGREE THE USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Vahati MAKES NO WARRANTY THE SERVICES WILL MEET YOUR REQUIREMENTS, OR THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES Vahati MAKES ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. This agreement will be governed by and construed in accordance with the laws of India without giving effect to principles of conflict of laws. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Vahati's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between you and Vahati.

This site is created and controlled by Vahati in Bangalore India; as such the laws of India shall apply; courts in Bangalore shall have jurisdiction in respect of all the terms, conditions and disclaimers. Use of the SMSmyEmail sites/services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree to indemnify and hold Vahati, its subsidiaries, affiliates, directors, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the SMSmyEmail sites/services, breach of these Terms of Use and/or any breach of your representations and warranties set forth above.
